1 Applicability of the General Terms and Conditions
The following general terms and conditions (GTC) apply to all contracts between mufabmo Yoga & Vanlife and its customers, unless otherwise agreed in certain cases. Customers (hereinafter referred to as "your") are to be understood as all persons who are/will be entitled by mufabmo Yoga & Vanlife (hereinafter referred to as "we") to take advantage of the course offer in accordance with point 2.
2 Conclusion of contract and booking
In accordance with §§ 145 et seq. of the German Civil Code (BGB), contracts between us (mufabmo Yoga & Vanlife) and you (customers) are concluded by offer and acceptance. As soon as you register for or book the yoga courses, workshops, seminars or other services offered by us (hereinafter referred to as "course offerings"), this is a binding offer on your part to conclude a corresponding contract within the meaning of § 145 BGB. Registration/booking is primarily done via an integrated booking system (YOGO). You can view their data processing agreement here. Each user creates a personal account, which is used to process all orders, payments and bookings.
Unless otherwise agreed in certain cases, you are only entitled to participate in a booked course offer if you have paid the corresponding invoice amount in full.
For workshops, full payment is a prerequisite for the binding confirmation of a place.
Registration is required for all classes. In case of no-show without canceling, the class will still be booked and charged. Cancellation is possible up to 5 hours before the start of the class.
We reserve the right to cancel a yoga class if there are fewer than 2 registrations or if the teacher is absent/ill. The cancellation will be sent by e-mail or SMS at least 1 hour before the start of the class!
We reserve the right to refund, transfer, or offer compensation of any kind for any course that is changed or cancelled by us for any reason.
3 Courses
3.1 Scope and implementation of the courses offered
We offer you yoga courses, workshops, seminars and other services, which are carried out in our yoga studios (mufabmo Yoga & Vanlife Hauptstraße 106, 91054), in specially rented premises or, in the case of personal yoga, by arrangement at your home.
We will also offer online courses . We use the streaming provider of the integrated Yogo booking tool to broadcast our specially marked online courses online.
In streaming, there is no video transmission by the provider, so you cannot be seen, neither by the yoga teacher nor by other participants.
3.2 Opening Hours and Changes to the Course Offerings
The opening hours of our studio and the current range of courses can be found on our website (www.mufabmo.de)
The studio opens about 15 minutes before the start of the lesson.
If you intend to participate in the courses offered on site, access to the yoga studio is only possible until the start of the event. After that, i.e. in the event of a late arrival, there is no longer any entitlement to access or participation in the respective course offer. During the course offer, the studio can no longer be entered from the outside. With this we would like to enable you to participate in yoga undisturbed.
We reserve the right to make necessary changes to opening hours, courses offered and teachers or lecturers teaching with us. This also applies to short-term closure and maintenance work, potential company holidays and a reduced range of courses or course cancellations during and between public holidays. We will inform you about such changes in good time via our website www.mufabmo.de or by e-mail.
With regard to workshops, we reserve the right not to hold the event or to postpone it if fewer than five participants are registered up to five days before the start of the event or if unforeseeable events occur (e.g. illness of the lecturer or similar). If you are affected as a customer, you will be informed by e-mail about the non-implementation or postponement of the appointment. In this case, we will offer you the opportunity to participate in an alternative date or in another workshop. In both cases, fees already paid will be charged. If you do not wish to participate in an alternative date or workshop, we will of course refund the fees already paid.
3.3 10-session cards, 5-session cards and single cards
We offer you 10-session tickets, 5-session tickets as well as single tickets, which entitle you to book or participate in our regularly offered yoga courses. Excluded from this are workshops, events, specials, course series and private lessons.
5-session tickets and 10-session tickets are available for booking individual yoga courses (whether of 60, 75 or 90 minutes duration). Single tickets are used to participate in a single yoga class.
10-session tickets, 5-session tickets and single tickets are valid for one customer each, are personal and cannot be transferred to third parties. Only in exceptional cases (e.g. pregnancy, relocation, permanent illness or injury) can the named cards be transferred to third parties. This requires coordination with us, for which we ask for written information in advance by e-mail to info@mufabmo.de. The regular 5-session tickets and 10-session tickets are valid for six (5-session tickets) or twelve (10-session tickets) months from the first participation booked with them.

After their validity date has expired, monthly tickets, 10-session tickets and 5-session tickets that have already been paid for expire. In this case, there is no entitlement to a refund of fees paid.
Only in exceptional cases (pregnancy or serious and permanent injury / illness lasting more than three weeks upon presentation of a medical certificate) can the validity period of monthly tickets, 10-class tickets and 5-session tickets be extended free of charge by the period of cancellation. This requires coordination with us, for which we ask for written information in advance by e-mail to info@mufabmo.de. 3.5 Membership
We offer you a membership that entitles you to book our regularly offered online courses or to use the online library for an unlimited number of months. Excluded from this are workshops, events, specials, course series and private lessons. As a member, you will receive a discount of ten percent on participation in workshops.
Membership is valid for one customer at a time, is personal and not transferable to third parties.
Membership can be completed on the desired start date by booking online via the website or by signing a membership agreement (we provide it by e-mail).
The membership fee will be debited from your account for the first time on the day of the start of the agreement and from then on a monthly basis (e.g. by SEPA direct debit).
Membership is ongoing and automatically renews every month.

If the membership was concluded online via the website, the cancellation must be made online via the website. Otherwise, the cancellation of membership must be made in writing and addressed to mufabmo Yoga & Vanlife, Gabriele Hennecke, Hauptstraße 106, 91054 Erlangen.
Extraordinary termination is only possible in the event of studio closure due to a pandemic, pregnancy, relocation from Erlangen or a serious and permanent injury / illness upon presentation of a medical certificate.
If the services offered are not used, this does not release you from the obligation to make the monthly payments. A refund of paid fees is excluded. Nor is there a claim to a reduction in the monthly instalments.
4 Prices and terms of payment
4.1 Prices
Our current price list is available on our website www.mufabmo.de and on site in the yoga studio, where you can find the regular and reduced prices and fees valid for our course offerings as well as additional information on booking the course offer.
4.2 Due date and form of payment
Prices and fees for booking or participating in our courses are due immediately upon conclusion of the contract, unless otherwise agreed. In the case of regular online bookings, payment of the invoiced prices or fees is made via the payment service provider Stripe. (Stripe Payments Europe Limited (1Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland; "Stripe"). The individual payment methods via "Stripe" are displayed to you under a corresponding button on our website and in the online ordering process. "Stripe" can use other payment services for payment processing; insofar as special payment conditions apply to this, you will be informed of these separately. After prior consultation, payment can also be made by voucher or by bank transfer to the mufabmo Yoga & Vanlife account specified in the invoice.
4.3 Discounts, promotional offers and vouchers
Discounts or promotional offers can only be redeemed during the specified period of validity and vouchers can only be redeemed in the original. Only one discount can be taken into account at a time within a booking. Vouchers are valid for 3 years from the date of purchase.
6 Non-participation and termination
6.1 Cancellation, Cancellation, Failure, Non-Attendance
In the event of cancellation outside the cancellation period, interruption, failure or other non-participation in a booked and already paid course offer, there is no entitlement to a refund of the price or the fee or parts thereof.
Cancellation of courses on site in the studio is free of charge up to 5 hours before the start of the course. After that, 100% of the course fee is due.
Cancellation of online courses is free of charge up to 30 minutes before the start of the course. After that, 100% of the course fee is due.
Cancellation for courses is only possible via the website or, in exceptional cases, via WhatsApp.
If you are unable to participate in a course that has already been booked and paid for (e.g. courses, workshops, etc.), you have the option of transferring your place to another person. This requires timely information to be sent to us by e-mail info@mufabmo.de, at least 6 hours before the start of the event.
6.2 Statutory rights of termination and withdrawal
The statutory rights of termination and withdrawal to which you are entitled as a customer remain unaffected.
7 Liability
Liability for damages on the part of us mufabmo Yoga & Vanlife, our legal representatives or vicarious agents only exists if the damage is based on intent or gross negligence or was caused by culpable breach of an essential contractual obligation (cardinal obligation). According to the Federal Court of Justice, the latter means an obligation "the fulfilment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner may regularly rely".
In all other respects, we shall not be liable for damages – regardless of the legal grounds.
In cases in which, according to the first bullet point, we are liable for the breach of an essential contractual obligation without gross negligence or intent, the liability is limited to the extent of damage that we typically had to expect to occur at the time of conclusion of the contract due to the circumstances known to us at that time.
The above limitations or exclusions of liability do not apply to culpable injury to life, limb and health, to liability claims under the Product Liability Act or to a contractually agreed no-fault liability obligation.
We advise you not to bring any material or valuables into our yoga studio or other course rooms rented by us, as we do not take any responsibility for guarding them or other duties of care for them. If you deposit money, property or valuables on our premises/shelves, this does not create any obligations on our part in relation to these items.
Your participation in the course offer (also for online courses) is only in full health and at your own risk. By booking a course offer, you declare that you are aware that the yoga classes in our studio can be physically demanding and that you participate voluntarily in the knowledge that the yoga practice does not exclude risks such as injury, loss of property and death. In case of pregnancy as well as health complaints such as illnesses, injuries, previous operations, etc., you must independently obtain the consent of a doctor to carry out the yoga practice before participating in our course offer. In addition, when registering and participating in the course offer, you must inform the teacher or lecturer of existing health restrictions before the start of the event. We are liable for the proper functioning of the furnishings provided by us. However, we are not liable for damage to health that you suffer due to your participation in the events offered by us and also not for accidents caused by yourself.
With regard to our website, we assume no liability for the content of external links. The responsibility for the content of the pages linked to us lies exclusively with the operators of these pages.
8 Data protection
As part of the conclusion of the contract, we collect, transmit, process and store related personal data. However, this is only to the extent and for as long as it is necessary for the establishment, execution and processing of the conclusion of the contract and we are obliged to store this data due to legal regulations
9 Copyrights
All content on this website (such as images) is subject to German copyright law. Their further use, duplication, processing and transfer to third parties is prohibited or expressly requires our written permission. If you become aware of a copyright infringement on our part, we ask you to notify us accordingly so that we can check this and, if necessary, take action. can take measures against it.
10 Severability clause
Should individual provisions of our general terms and conditions be or become invalid or unenforceable, the validity of the remaining provisions of the GTC shall remain unaffected. In this case, the invalid or unenforceable provision must be replaced by a provision that comes closest to the original provision in terms of content, economy and law. The same applies to contractual gaps.
11 Final Provisions
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The applicability of mandatory provisions of the country in which the customer has his habitual residence at the time of conclusion of the contract remains unaffected by this choice of law.
For any disputes arising from the business relationship, Erlangen is the sole place of jurisdiction. To make a claim against the contractual partner at his general place of jurisdiction represents a mutual right and remains unaffected.
For out-of-court online dispute resolution, disputes can be submitted to the European Commission's online dispute resolution platform. https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage If you have made an online purchase and are a resident of the European Union, you can use this platform free of charge. In case of any discrepancies, the German version shall prevail over the English translation.
